Terms of Service

1. OVERVIEW

1.1. These terms and conditions and the documents referred to below (the "Terms") apply to the use of the Tonzo Lottery (the “Lottery”) and its related or connected services (collectively, the "Service").

1.2. You should carefully review these Terms as they contain important information concerning your rights and obligations concerning the use of the Service and form a binding legal agreement between you, our customer (the "Customer"), and us. By connecting with the Service to purchase Lottery tickets using your blockchain network wallet, you agree to be bound by these Terms, together with any amendments, which may be published from time to time. It is your responsibility to periodically review these Terms.  If you do not accept these Terms, you should refrain from using the Lottery and accessing the Service. Your continued use of the Service constitutes your ongoing acceptance of the Terms. 

1.3. The Service is operated by LFGC Limited, a company incorporated in the Autonomous Island of Anjouan with Company Number 15768 and address Hamchako, Mutsamudu, Autonomous Island of Anjouan, Union of Comoros (the “Company”). 

2. GENERAL TERMS

2.1. We reserve the right to amend and update these Terms (including any documents referred to and linked to below) at any time. You should visit this page periodically to review the Terms. Amendments to the Terms will be binding and effective immediately upon their publication here. If you disagree with any amendments to the Terms, you must immediately stop using the Service. Your continued use of the Service following such publication will indicate your agreement to be bound by the Terms as amended.  

3. YOUR OBLIGATIONS IN MAKING USE OF THE LOTTERY AND THE SERVICE

When accessing the Lottery and using the Service, you agree to the following obligations:

3.1. You confirm that you are over 18 years of age, or the legal age at which gambling, or gaming activities are allowed under the law or jurisdiction that applies to you. We may ask for proof of age documents from you at any time.

3.2. You have the legal capacity to enter into a binding legal agreement with us. You must not access the Lottery or utilise the Service if you do not have legal capacity.

3.3. You are not a resident of any country in which access to online gambling to its residents, or to any person within such country, is prohibited. It is your sole responsibility to ensure that your use of the Service is legal. The information set out below is not intended to encourage participation in the Lottery by persons in prohibited jurisdictions, or who are otherwise disqualified from participation under these Terms. 

3.4. Without prejudice to the provisions of clause 3.3 above, it is an express and material Term of this agreement that you may not, under any circumstances, access the Lottery or use the Service from any of the following jurisdictions: 

Australia, Comoros Islands, Cyprus, France, Germany, Netherlands, Ontario, Portugal, Spain, South Africa, United Kingdom, United States of America and its territories, all FATF blacklisted countries, all countries sanctioned by the United Kingdom or the United States of America, and any jurisdiction prohibited by the Anjouan Offshore Financial Authority. By using the Service, you affirm you are not residing in, or playing from any of these prohibited jurisdictions.

3.5 If you are a resident of any country in which access to online gambling to its residents, or to any person within such country is prohibited, or if you access the Service from any of the jurisdictions listed or referenced in clause 3.4 above and you win on our Lottery, such win shall not be paid out and all Lottery tickets, bonus tickets and winnings will be forfeited.

3.6  You may not use a VPN, proxy or similar services or devices that mask or manipulate the identification of your real location. The attempt to manipulate your real location through the use of VPN, proxy, or similar services or through the provision of incorrect or misleading information about your place of residence, with the intent to circumvent geo-blocking or jurisdiction restrictions, constitutes a breach of these Terms.

3.7. You warrant that you control and are the legal and genuine owner of any currency you send to us and any wallet address you connect with us. You are responsible for the management of your wallet. 

3.8. You must make all payments to us in good faith and not attempt to cancel a payment made or take any action which will cause such payment to be reversed by a third party.

3.9. You acknowledge the risk of losing currency when purchasing tickets for the Lottery and you accept that you will be fully responsible for that loss.

3.10. You are using the Service for personal, non-commercial purposes only.

3.11. You must not attempt to manipulate the Service, nor any of its elements in bad faith, nor in a manner that adversely affects the integrity of the Service or us.

3.12. You confirm that you will act in good faith in relation to your use of the Service at all times.

3.13. You agree to provide true, accurate, and complete information about yourself at all times, including when requested by us. 

3.14. You are solely responsible for reporting and accounting for any taxes applicable to you under relevant laws for any winnings that you make using the Service. 

3.15. You confirm that you are not a compulsive gambler and do not suffer from a gambling addiction. 

3.16. You confirm you will not use any third-party software in any part of the Service, nor exploit any bugs found on the Lottery or within the Service.

3.17. You confirm that all information provided to us at any time, is accurate and you will promptly notify us of any changes to this information.

4. RESTRICTIONS ON USE OF THE SERVICE

4.1. You must not use the Service:

4.1.1. for any form of illicit activity, including money laundering, terrorist financing or trade sanctions violations, under any relevant jurisdictions' laws, regulations and norms; 

4.1.2.for collecting other customers’ personal information, wallet addresses, or other information without permission (for example, by sending spam, or the unauthorised framing of, or linking to, the Service);

4.1.3. to disrupt or interfere with, or to influence the activities of other customers or the operation of the Service generally;

4.1.4. to distribute unsolicited commercial advertisements, affiliate links, and other forms of solicitation which may be removed from the Service without notice;

4.1.5. in any manner that we deem to be an attempt to cheat the Service, or another customer, or to collude with another customer for dishonest gain;

4.1.6. to violate any of our intellectual property rights.

4.2. Using software that provides an unfair advantage, or any software that aids in making decisions or employing strategies to unjustly gain winnings or an advantage over the Service, is prohibited. We reserve the right to confiscate this currency. These actions are exercised at our sole discretion and are final.

Should the amount of illicitly gained currency exceed the purchased ticket values, we reserve the right to recover such amounts as were paid out from you the Customer.

5. REGISTRATION PROCESS 

5.1. You agree at all times when using the Service:

5.1.1 That there is no obligation on our part to sell Lottery tickets to you. We reserve the right to refuse to sell Lottery tickets to you without explanation. 

5.1.2. That before using the Service, you must personally connect your wallet to the Service. 

5.1.3. TON is the name of the native crypto currency used within the Telegram messaging application. We will hereafter use “TON” in these Terms.

5.1.4. In order to start purchasing Lottery tickets on the Service, or in order to withdraw your winnings, we may require you to become a verified Customer which includes passing certain verification checks. You may be required to provide valid proof of identification and proof of address and any other document as may be deemed necessary. This includes but is not limited to, a picture ID (copy of passport, driver's licence or national ID card) and a recent utility bill listing your name and address as proof of residence. We reserve the right to suspend access to the Lottery or restrict withdrawals, until the required information is received. This procedure is done in accordance with gaming regulations, anti-money laundering laws and good corporate governance. If you fail to undergo an identity verification process successfully and you win on our Lottery, such win shall not be paid out and all Lottery tickets, bonus tickets and winnings will be forfeited.

5.1.5. Not to share any Service content or information with others by screen capture or any method that differs from direct access.

5.2. Upon successful connection of your wallet to the Service, you can use USDT or other currencies specified in the app, which will be automatically converted to USDT using reputable independent data sources for the conversion rate, for purchasing tickets.

5.3. We comply with relevant laws for preventing money laundering and terrorism financing. All suspicious transactions will be investigated without informing the involved Lottery customer or third parties.

5.4. We reserve the right to conduct checks on transactions to prevent illegal activities. By agreeing to the Terms, you authorize personal identification checks to confirm your identity. We may contact you for additional information to comply with our regulatory and legal obligations.

5.5. Providing false or misleading information to us at any time, is a serious violation of these Terms and may lead to the cancellation of outstanding Lottery tickets and bonus tickets and the confiscation of winnings.

6. CUSTOMER USE

6.1. We do not give credit for the use of the Service.

6.2. We reserve the right to refuse to sell Lottery tickets to you without explanation.  

6.3  We may refuse to sell additional Lottery tickets to you if you are not, or we reasonably believe that you are not, complying with these Terms, or to ensure the integrity or fairness of the Service. If you are not complying with these Terms or we suspect as much, we may cancel outstanding Lottery tickets purchased and confiscate bonus tickets and winnings. 

6.4. If any amount is mistakenly credited to your blockchain network wallet it remains our property and when we become aware of any such mistake, we shall notify you and the amount shall be returned by you to the Company.

6.5. Betting should be for entertainment only. Stop if it's no longer enjoyable. Never wager more than you can afford to lose. 

6.6. Betting history is retained for no longer than 90 (ninety) days.

7.1. To participate in the Tonzo Referral Program, a user must have created a valid Tonzo account by connecting their blockchain wallet to the Service.

7.2. Upon registration, users may generate a unique referral link via the Tonzo app. This link may be used to refer new users to the Service.

7.3. Referral rewards are issued in USDT and calculated as a percentage of the total USDT spent by referred users on Lottery tickets. The default base referral rate will be displayed in the app at the time the referral link is created.

7.4. Tonzo reserves the right to amend the referral reward rate at any time, with or without notice. Custom referral arrangements, including bespoke rates and incentives, may be offered to affiliates or selected partners at Tonzo’s discretion.

7.5. Referral earnings are subject to verification. We reserve the right to freeze or withhold referral rewards and suspend access to the Service if either the referrer or the referred user fails to pass KYC verification, or engages in suspicious or prohibited conduct.

8.1 For the purposes of these Terms:

8.2 Choose which draw, either daily or weekly, you wish to purchase tickets for.

8.3 Choose how many Lottery tickets you want to purchase. Lottery tickets are purchased using USDT tokens. The cost of the tickets will be displayed in USDT on the app before purchase.

8.4 Lottery tickets can be randomly generated using the auto-select feature. Alternatively, you may choose to select your own numbers. You may purchase more than one Lottery ticket for an individual Lottery draw. The same numbers may be entered on multiple Lottery tickets in the same individual Lottery draw and also on future Lottery draws.

8.5 Once you have selected your numbers, you must choose the number of draws that you would like to enter and then click on the purchase button. Once the purchase is confirmed, the Lottery ticket(s) will be entered in the relevant number of draws selected, with the relevant number of Lottery ticket(s) entered into each draw.

8.6 Once a Lottery ticket has been purchased you cannot cancel or withdraw from the Lottery.

8.7 The Lottery runs two separate draws:

8.8 Lottery results can be viewed on the Tonzo bot and in the Tonzo community channel on the Telegram messaging application.

8.9 Any winnings generated from a winning ticket held by you will be credited to your account balance on the Tonzo app. To receive your winnings, you must request a balance withdrawal and the funds will be transferred to your connected blockchain network wallet.

8.10 After each Lottery draw, the Service automatically calculates winners and updates the prize pool (with the rollover amount, if any) for the next Lottery draw. Prizes will be paid out up to 48 hours after the winners have been calculated.

8.11 If more than one Lottery customer hits the Lottery jackpot, the winnings will be shared equally amongst the customers that hold the same winning numbers.

8.12 For the Weekly Draw, the Prize Pool must be won and distributed in each draw. No portion of the Prize Pool will be carried over or withheld.

8.13 Prize Pool rewards in the Weekly Draw are allocated to non-jackpot matches — that is, customers who correctly match a lower combination of Balls and/or Powerballs without achieving the jackpot match — based on defined match criteria.

8.14 The Prize Pool is divided into weighted allocations according to the probability of matching specific numbers (e.g., matching 3 Balls vs. 4 Balls). Lower-probability outcomes receive a proportionally higher percentage of the Prize Pool than higher-probability outcomes.

8.15 If more than one customer qualifies for the same match criteria in the Weekly Draw (e.g., multiple customers match 4 Balls), the allocated portion of the Prize Pool for that match category will be shared equally among those winners.

8.16 In the event that a specific weighted allocation (e.g., for matching 3 Balls) is not won in a Weekly Draw, the unclaimed portion will be redistributed across the remaining winning match categories based on the original weightings, thereby ensuring the full Prize Pool is awarded in that draw.

8.17 The Lottery prize pool amount is displayed in USDT.

8.18 Customers are able to view a full history of Lottery tickets previously purchased and Lottery tickets still to be played.

8.19 We reserve the right to cancel the Lottery or to modify its structure, benefit, or other features at any time for any or no reason, without providing an explanation. Refunds for Lottery tickets purchased will be offered by us in these circumstances.

8.20 Where we consider it reasonable to do so, we may postpone a Lottery draw for so long as we consider to be appropriate in the circumstances.

9.1 All Lottery ticket purchases should be made from a suitable blockchain network wallet. In agreeing to these Terms you expressly agree to us providing any personal information necessary to process the transaction, including where necessary passing information outside of your country of residence.

9.2 We reserve the right to pass on to you at any time fees and charges that may apply to customer Lottery winnings.

9.3 You agree to fully pay any and all payments and charges due to us in connection with your use of the Service.

9.4 If you accept a bonus ticket awarded during the use of the Service, you agree to these Terms when using the bonus ticket to enter into the Lottery.

9.5 Funds originating from criminal and/or illegal and/or unauthorized activities must not be used to purchase Lottery tickets.

9.6 We reserve the right to cancel or modify the Lottery or to not credit any winnings to your wallet in cases of conspiracies, collusion, lottery manipulation, lottery fault exploitation, fraud, technical failures, criminal activities, or falsifications.

9.7 Refunds for Lottery tickets purchased are not offered by us, except as mentioned in these Terms. By purchasing a ticket, you agree to not pursue reversals, refunds, or cancellations of Lottery tickets.

10.1 For the purposes of these Terms:

10.2 You may choose from multiple types of Scratch Cards available in the Tonzo app. Each Scratch Card must be purchased using USDT tokens. The cost of the selected Scratch Card will be displayed in USDT prior to purchase.

10.3 Once purchased, a Scratch Card cannot be cancelled, refunded, or withdrawn.

10.4 To play, you must reveal the scratch area on the Scratch Card within the app. A win occurs when you Match the required Symbols in the configuration shown in the app UI.

10.5 Each Scratch Card has multiple prize tiers. Winning is not limited to an all-or-nothing outcome. The value of prizes available for each Scratch Card type is displayed in USDT within the app.

10.6 Scratch Card results and prize outcomes are generated and determined automatically by the Service.

10.7 Any winnings generated from a Scratch Card held by you will be credited to your account balance on the Tonzo app. To receive your winnings you must request a balance withdrawal and the funds will be transferred to your connected blockchain network wallet.

10.8 Where more than one customer qualifies for the same prize tier in a Scratch Card series, the Service does not pool or share winnings; each winning ticket is awarded its full prize amount independently.

10.9 All Scratch Card costs and prizes are displayed in USDT.

10.10 Customers are able to view a full history of Scratch Cards previously purchased, including outcomes and winnings, within the Tonzo app.

10.11 We reserve the right to cancel, suspend, or modify the Scratch Card game or its prize structures, reward mechanics, or availability at any time for any or no reason, without providing an explanation. Refunds for Scratch Cards purchased will only be offered in these circumstances.

10.12 Where we consider it reasonable to do so, we may temporarily suspend the Scratch Card game in order to address technical or operational issues.

11.1 All Scratch Card purchases should be made from a suitable blockchain network wallet. In agreeing to these Terms you expressly agree to us providing any personal information necessary to process the transaction, including where necessary passing information outside of your country of residence.

11.2 We reserve the right to pass on to you at any time fees and charges that may apply to customer Scratch Card winnings.

11.3 You agree to fully pay any and all payments and charges due to us in connection with your use of the Service.

11.4 If you accept a bonus Scratch Card awarded during the use of the Service, you agree to these Terms when using the bonus Scratch Card to enter into the game.

11.5 Funds originating from criminal and/or illegal and/or unauthorized activities must not be used to purchase Scratch Cards.

11.6 We reserve the right to cancel or modify the Scratch Card game or to not credit any winnings to your wallet in cases of conspiracies, collusion, fault exploitation, fraud, technical failures, criminal activities, or falsifications.

11.7 Refunds for Scratch Cards purchased are not offered by us, except as mentioned in these Terms. By purchasing a Scratch Card, you agree to not pursue reversals, refunds, or cancellations of Scratch Cards.

12. WITHDRAWALS

12.1. Any winnings generated from a winning Lottery ticket held by you will be credited to your Tonzo account balance. If you are a resident of any country in which access to online gambling to its residents, or to any person within such country is prohibited, or if you access the Service from any of the jurisdictions listed or referenced in clause 3.4 above, and you win on our Lottery, such win shall not be paid out and all Lottery tickets, bonus tickets and winnings will be forfeited.

12.2. We reserve the right to request photo ID, address confirmation or perform additional verification procedures (request your selfie, arrange a verification call etc.) for the purpose of identity verification prior to crediting any winnings to your wallet. We also reserve our right to perform identity verification at any time during the lifetime of your relationship with us.  If you fail to undergo an identity verification process successfully and you win on our Lottery, such win shall not be paid out and all Lottery tickets, including bonus tickets and winnings will be forfeited.

12.3. Our anti-fraud system's procedures may extend the waiting time for winnings to be paid to your wallet to ensure financial security for customers, potentially up to (7) seven days or more as necessary.

12.4. For winnings of 100,000 USDT or higher, we reserve the right to distribute the payment in parts over a maximum of 90 (ninety) days.We also reserve the right, at our sole discretion, to pay out the jackpot prize in currencies other than USDT, including but not limited to USD, TON, and other fiat currencies.

13. PROCESSING OF PAYMENTS

13.1. You are fully responsible for paying for all Lottery tickets purchased. You must make all payments to us in good faith and not attempt to reverse a payment made or take any action which will cause such payment to be reversed by a third party in order to avoid a liability legitimately incurred. You will compensate us for any denial or reversal of a payment you make and any loss suffered by us as a consequence thereof.

13.2. Before making a Lottery ticket purchase, ensure the accuracy of the lottery recipient details and the token's chain, and verify that the payment amount—whether in USDT or its equivalent value in other accepted currencies—meets the minimum required amount to cover the Lottery ticket(s) intended to be purchased. Should there be any errors in purchasing ticket(s), the responsibility rests solely with you.

13.3. All transactions made on our Lottery may be checked to prevent money laundering or terrorism financing activity. Suspicious transactions will be reported to the relevant authority.

14.1. Tonzo reserves the right to stake tokens that have been deposited as part of Lottery ticket purchases or that are otherwise held within the Service for operational, liquidity, or prize pool purposes.

14.2. Any staking rewards generated through such activities shall be retained by Tonzo and shall not form part of any user's account balance or entitlements.

14.3. This right shall be exercised in a manner that does not affect the integrity of the Lottery or users’ rightful claims to winnings or legitimate withdrawals.

14.4. In the event that staking results in impermanent loss or any other form of reduction in token value, such loss shall be borne solely by the Lottery. Users shall remain entitled to the full value of their winnings, ticket balances, or prize pool allocations as if no staking activity had occurred.

15.1. Tonzo may operate a membership program through which users can earn points (“Tonzo Points”) for engaging with the Service. These points may be used to unlock in-app benefits or advance through reward tiers.

15.2. Tonzo Points have no monetary value, are non-transferable, and may not be exchanged for cash or digital currency.

15.3. Tonzo may, from time to time, offer gamified rewards such as scratch cards, lootboxes, or similar digital reward mechanisms. These features are designed for engagement and entertainment purposes and may include variable rewards of differing types and values. The structure, content, and availability of these rewards are subject to change at Tonzo’s sole discretion.

15.4. Rewards provided through Tonzo Points or gamified mechanisms may include physical or digital products, experiences, or services from third-party suppliers. Tonzo does not provide any warranties or guarantees regarding the availability, functionality, quality, or value of such third-party products or services, and disclaims all liability related to their use, delivery, or condition.

15.5. Rewards, including but not limited to scratch cards, lootboxes, and any prizes obtained from them, are non-transferable, cannot be exchanged for cash or cryptocurrency, and may not be sold, traded, or transferred between users under any circumstances.

15.6. Tonzo reserves full discretion to determine the criteria for awarding Points, the thresholds and structure of any membership tiers, and the nature of any associated benefits or rewards. These criteria and benefits may be changed, suspended, or removed at any time, with or without notice.

15.7. Participation in the Points and Rewards Program does not create any right, title, or interest in the Points themselves, and Tonzo may revoke, limit, or modify the availability of such Points and rewards at its sole discretion.

16. ERRORS

16.1. In the event of an error or malfunction of our Lottery, the Service, our systems or processes, we reserve the right to cancel or to modify the Lottery draws in question. You are under an obligation to inform us immediately as soon as you become aware of any error with the Service. 

16.2. In the event of communication or system errors, bugs or viruses occurring in connection with the Service and/or payments made to you, as a result of a defect or error in the Service, we will not be liable to you or to any third party for any direct or indirect costs, expenses, losses or claims arising or resulting from such errors, and we reserve the right to cancel or modify all Lottery draws in question and take any other action to correct such errors.  We are entitled to recover any overpaid amounts from you in these circumstances.

17. RULES GOVERNING PLAY 

17.1. Customers are responsible for their transactions. Completed transactions cannot be altered. 

18. COMMUNICATIONS AND NOTICES

18.1. All communications and notices to be given under these Terms by you to us shall be sent to us in writing addressed on our community support channel on the Telegram messaging application.

18.2.  We will deliver communications and notices to you under these Terms, unless stated otherwise within these Terms, by posting information on the Lottery in the English language.

19. MATTERS BEYOND OUR CONTROL

19.1. We are not liable for any Service failures or delays resulting from Force Majeure events that are beyond our reasonable control. Such events may include fire, flood, earthquake, storm, hurricane or other natural disasters; war, invasion, an act of a foreign enemy; civil war; terrorist activities; strikes and labour disputes; power outages; acts, failures, or omissions by governments or authorities including sanctions; telecommunications disruptions; or any other third-party caused delays or failures. We assume no responsibility for any loss or damage you may incur due to these circumstances. In the event of such Force Majeure, we reserve the right to cancel or suspend access to the Lottery without any liability.

20. LIABILITY

20.1. TO THE EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT COMPENSATE YOU FOR ANY REASONABLY FORESEEABLE LOSS OR DAMAGE (EITHER DIRECT OR INDIRECT) YOU MAY SUFFER IF WE FAIL TO CARRY OUT OUR OBLIGATIONS UNDER THESE TERMS UNLESS WE BREACH ANY DUTIES IMPOSED ON US BY LAW (INCLUDING IF WE CAUSE DEATH OR PERSONAL INJURY BY OUR NEGLIGENCE) IN WHICH CASE WE SHALL NOT BE LIABLE TO YOU IF THAT FAILURE IS ATTRIBUTED TO: (I) YOUR OWN FAULT; (II) A THIRD PARTY UNCONNECTED WITH OUR PERFORMANCE OF THESE TERMS (FOR INSTANCE PROBLEMS DUE TO COMMUNICATIONS NETWORK PERFORMANCE, CONGESTION, AND CONNECTIVITY OR THE PERFORMANCE OF YOUR COMPUTER EQUIPMENT); OR (III) ANY OTHER EVENTS WHICH NEITHER WE NOR OUR SUPPLIERS COULD HAVE FORESEEN OR FORESTALLED EVEN IF WE OR THEY HAD TAKEN REASONABLE PRECAUTIONS. AS THIS SERVICE IS FOR CONSUMER USE ONLY WE WILL NOT BE LIABLE FOR ANY BUSINESS LOSSES OF ANY KIND.

20.2. IN THE EVENT THAT WE ARE HELD LIABLE FOR ANY EVENT UNDER THESE TERMS, OUR TOTAL AGGREGATE LIABILITY TO YOU UNDER OR IN CONNECTION WITH THESE TERMS SHALL NOT EXCEED (A) THE VALUE OF THE LOTTERY TICKET PURCHASED THAT GAVE RISE TO THE RELEVANT LIABILITY, OR (B) USD $500 IN AGGREGATE, WHICHEVER IS LOWER.

20.3. WE STRONGLY RECOMMEND THAT YOU (I) TAKE CARE TO VERIFY THE SUITABILITY AND COMPATIBILITY OF THE SERVICE WITH YOUR OWN COMPUTER EQUIPMENT PRIOR TO USE; AND (II) TAKE REASONABLE PRECAUTIONS TO PROTECT YOURSELF AGAINST HARMFUL PROGRAMS OR DEVICES INCLUDING THROUGH INSTALLATION OF ANTI-VIRUS SOFTWARE.

21. GAMBLING BY THOSE UNDER AGE

21.1. If there's suspicion that you are under 18 years old, or were under 18 at the time you made a Lottery ticket purchase via the Service, we will suspend your ability to purchase further Lottery tickets and restrict withdrawals. We will investigate, including checking if Lottery ticket purchases were made on behalf of someone under 18 or below the legal age in your jurisdiction. If it's determined that you were under the legal age, or purchasing Lottery tickets for someone who was, all winnings will be withheld. You must return any winnings obtained while underage upon our request; failure to comply will lead to efforts to recover such amounts. Any non-winnings currency may be returned or held until you reach 18, at our discretion, minus any transaction fees.

21.2. This rule also applies if you are over 18 but are purchasing Lottery tickets from a jurisdiction with a higher legal betting age and you are below that jurisdiction's legal age.

21.3. If we suspect you're violating this clause or using it fraudulently, we'll take necessary actions to investigate, including notifying law enforcement.

22. ANTI-FRAUD POLICY

22.1. The use of the Service for illegal activities, such as money laundering, terrorist financing, or violations of trade sanctions, is strictly forbidden. The risk department is authorized to halt any transaction deemed suspicious to prevent money laundering until compliance with all requirements is verified, halting payment during the investigation.

22.1.1. We reserve the right to request, without needing to provide a reason, confirmation of the origin of currency used to purchase Lottery tickets;

22.1.2. We hold the authority to limit, suspend, or terminate access to the Lottery without prior notification under circumstances including, but not limited to:

- Suspicions that your purchase of Lottery tickets has encountered an operational or other error, necessitating a suspension until the issue is resolved;

- Suspicions of dishonest manipulation of our Services or the taking of unfair advantage of us, or our Services (including but not limited to the utilisation of software or other means to gain an advantage, or the exploitation of loopholes, faults or technical errors within our software or Lottery functionality);

- Suspicions of your involvement in unlawful activities, fraudulent activities, or violations of our Terms;

- Associations or high risks of your association with money laundering, terrorist financing, fraud (including but not limited to identity fraud, payment fraud, forgery, collusion with other individuals, abusing promotional offers or other cheating), or other financial crimes;

- Suspicions of the use of automated players (sometimes known as bots);

- Requirements by law enforcement or regulatory authorities through subpoenas, court orders, or other legal mandates.

22.1.3. We reserve the right to mandate payment of winnings to the same wallet used for purchasing Lottery tickets. Additionally, in cases of suspected anti-money laundering policy breaches, undergoing an identity verification process may be required at any point, as a compulsory measure for all Lottery customers. We may suspend your ability to purchase further Lottery tickets and restrict withdrawals, if requested to do so in accordance with anti-money laundering legislation or on any other legal basis requested by any state authority whose authority. If you fail to undergo an identity verification process successfully and you win on our Lottery, such win shall not be paid out and all Lottery tickets, bonus tickets and winnings will be forfeited.

23. INTELLECTUAL PROPERTY

23.1. Any unauthorised use of our name and logo may result in legal action being taken against you.

23.2. As between us and you, we are the sole owners of the rights in and to the Service, our technology, software and business systems (the "Systems").

23.3. You may not use our Service, Systems, trademarks, trade names and/or trade dress, logos ("Marks") in connection with any product or service that is not ours, that in any manner is likely to cause confusion among customers or in the public or that in any manner disparages us.

23.4. Except as expressly provided in these Terms, we do not grant you any express or implied rights, title or interest in or to the Lottery, the Service, the Systems or the Marks and all such rights, title and interest are specifically retained by us and our licensors. You agree not to use any automatic or manual device to monitor or copy content within the Service. Any unauthorized use or reproduction may result in legal action being taken against you.

24. YOUR RIGHTS 

24.1. Subject to these Terms and your compliance with them, we grant to you a non-exclusive, limited, non-transferable right to access and use the Service for your personal non-commercial purposes only. This right terminates if our agreement with you under these Terms ends.

24.2. Save in respect of your own content, you may not under any circumstances modify, publish, transmit, transfer, sell, reproduce, upload, post, distribute, perform, display, create derivative works from, or in any other manner exploit, the Service and/or any of the content thereon or the software contained therein, except as we expressly permit in these Terms or otherwise permitted on the Lottery. No information or content on the Service or made available to you in connection with the Service may be modified or altered, merged with other data or published in any form including for example screen or database scraping and any other activity intended to collect, store, reorganise or manipulate such information or content.

24.3. Any non-compliance by you with this clause may also be a violation of our or third parties' intellectual property and other proprietary rights which may subject you to civil liability and/or criminal prosecution.

25. YOUR CONDUCT AND SAFETY

25.1. For your protection and protection of all our customers, the posting of any content on the Service, as well as conduct in connection there with and/or the Service, which is in any way unlawful, inappropriate or undesirable is strictly prohibited (“Prohibited Behaviour”).

25.2. Engaging in Prohibited Behaviour may result in the immediate termination of your access to the Service without notice. Legal actions could be taken against you by another customer, third parties, enforcement authorities, or us for engaging in Prohibited Behaviour.

25.3. Prohibited Behaviour includes, but is not limited to, accessing or using the Service to:

25.3.1. Promote or share information that you know is false, misleading or unlawful;

25.3.2. Conduct any unlawful or illegal activity, such as, but not limited to, any activity that furthers or promotes any criminal activity or enterprise, violates another customer's or any other third party’s privacy or other rights, or that creates or spreads computer viruses;

25.3.3. Harm minors in any way;

25.3.4. Share unlawful, harmful, threatening, abusive, defamatory, vulgar, obscene, violent, hateful, or objectionable content;

25.3.5. Share content you have no legal right to share, infringing on intellectual property rights;

25.3.6. Share any material containing software viruses or codes intended to disrupt or alter the Service or any computer software or hardware;

25.3.7. Interfere with, disrupt, or reverse engineer the Service;

25.3.8. Use robots or automated mechanisms to index information from the Service;

25.3.9. Engage in actions leading to defrauding or scamming other customers;

25.3.10. Send unsolicited or unauthorized advertising or solicitations;

25.3.11. Impersonate others or engage in fraudulent activities;

25.3.12. Use cheats, bots, or exploit system errors for unfair advantages;

25.3.13. Participate in criminal activities, including money laundering; or 

25.3.14. Any other act or thing done that we reasonably consider to be contrary to our business principles.

The above list of Prohibited Behaviour is not exhaustive and may be modified by us at any time or from time to time. We reserve the right to investigate and to take all such actions as we in our sole discretion deem appropriate or necessary under the circumstances.

If you suspect any Lottery customer of cheating, collusion, or fraudulent activities, please report it to us immediately. We reserve the right to terminate Lotteries to prevent fraud.

26. LINKS 

26.1. The Service may contain links to third party platforms, websites or resources that are not maintained by, or related to, us, and over which we have no control. Links to such platforms and websites are provided solely as a convenience to customers, and are in no way investigated, monitored or checked for accuracy or completeness by us. Links to such platforms and websites do not imply any endorsement by us of, and/or any affiliation with, them or their content or their owner(s). We have no control over or responsibility for the availability nor their accuracy, completeness, accessibility and usefulness. Accordingly when accessing such platforms and websites we recommend that you should take the usual precautions including reviewing their privacy policy and terms of use.

27. COMPLAINTS

27.1. If you have any concerns or questions regarding these Terms you should contact us in the English language using the community support channel on the Telegram messaging application. 

27.2. We assume no liability to you or any third party in responding to or addressing any complaints received.

27.3. We shall use our reasonable endeavours to respond to queries within a few days (and in any event we intend to respond to all such queries within 28 (twenty eight) days of receipt).

27.4. Disputes must be submitted within 14 (fourteen) days from the decision date of the query in question. Claims made beyond this timeframe will not be considered. You are responsible for monitoring your Lottery ticket purchases and transactions 

27.5. In the event of a dispute arising between you and us our Customer Service Department will attempt to reach an agreed solution. Should our Customer Service Department be unable to reach an agreed solution with you, the matter will be escalated to our management for further review.

27.6. If resolutions offered are unsatisfactory, you have the right to file a complaint with our licensing authority.

28. ASSIGNMENT

28.1. Neither these Terms nor any of the rights or obligations hereunder may be assigned by you without the prior written consent of us. We may, without your consent, assign all or any portion of our rights and obligations hereunder to any third party provided such third party is able to provide a service of substantially similar quality to the Service, by posting written notice to this effect on the Lottery.

29. SEVERABILITY

29.1. In the event that any provision of these Terms is deemed by any competent authority to be unenforceable or invalid, the relevant provision shall be modified to allow it to be enforced while retaining the original intent as closely as possible, as allowed by law. The validity and enforceability of the remaining provisions of these Terms shall remain unaffected.

30. BREACH OF THESE TERMS

30..1. Without limiting our other remedies, we may suspend your access to the Lottery or restrict withdrawals, in either case without giving you prior notice, if, in our reasonable opinion, you have materially breached these Terms. Notice of any such action taken will, however, be promptly provided to you.

You agree to indemnify and hold the Company and its affiliates harmless against all claims, costs, damages, and expenses arising from your breach of these Terms, your breach of any law, or your breach of third party rights in connection with your use of the Service.

31.  RESPONSIBLE GAMBLING

31.1. Betting should be for entertainment only. Stop if it's no longer enjoyable. Never wager more than you can afford to lose.

32. GENERAL PROVISIONS

32.1. Term of agreement. These Terms shall remain in full force and effect while you access or use the Service or are a Customer of the Lottery.

32.2. Gender. Words importing the singular number shall include the plural and vice versa, words importing the masculine gender shall include the feminine and neuter genders and vice versa and words importing persons shall include individuals, partnerships, associations, trusts, unincorporated organisations and corporations.

32.3. Waiver. No waiver by us, whether by conduct or otherwise, of a breach or threatened breach by you of any term or condition of these Terms shall be effective against, or binding upon, us unless made in writing and duly signed by us, and, unless otherwise provided in the written waiver, shall be limited to the specific breach waived. The failure of us to enforce at any time any term or condition of these Terms shall not be construed to be a waiver of such provision or of the right of us to enforce such provision at any other time.

32.4. Acknowledgement. By using the Service, you acknowledge your full understanding and agreement to these Terms, waiving any future dispute against their contents.

32.5. Language. The English version of these Terms prevails over any other language version in case of discrepancies.

32.6. Governing Law. These Terms are governed by the law in force in the Autonomous Island of Anjouan.  You irrevocably consent to the exclusive jurisdiction of the courts of the Autonomous Island of Anjouan for any claims, disputes, or differences concerning these Terms and any issues arising from them. You irrevocably waive any right to object to proceedings in these courts, claim the proceedings have been brought in an inconvenient forum, or contest the jurisdiction of these courts. This clause does not limit our right to initiate proceedings against you in any other competent jurisdiction, nor does it prevent proceedings in multiple jurisdictions concurrently, as allowed by the law of such jurisdictions.

32.7. Entire agreement. These Terms constitute the entire agreement between you and us with respect to your access to and use of the Service, and supersedes all other prior agreements and communications, whether oral or written with respect to the subject matter hereof.
